Her AI-Generated Video Swayed the Judge. The Court Said it Carried 'Undue Emotional Weight'

Her AI-Generated Video Swayed the Judge. The Court Said it Carried 'Undue Emotional Weight'

A man convicted of manslaughter in Arizona will be resentenced because an AI-generated video of his victim speaking from beyond the grave was ruled to have carried “undue emotional weight” as an impact statement. An appellate court in Arizona ruled that the manslaughter charge will remain, but the judge must reconsider the length of the man’s prison term because of AI.

In 2021, Gabriel Horcasitas shot and killed Christopher Pelkey during a road rage incident. A jury found him guilty of manslaughter. During Horcasitas’ sentencing hearing, Pelkey’s sister Stacey Wales played an AI-generated video of her brother as part of her victim’s impact statement. In the video, which she scripted with her own words that she made an AI generated likeness of Pelkey say, the AI avatar of Pelkey forgives his killer and said they “could have been friends” in another life.

“I loved that video,” the judge said while handing down the maximum sentence of 10 and a half years.

Wales told 404 Media that her intent with the video was to sway the judge. “Isn’t that what you want human connection to be?” she said. “Do you ever come out of a movie and say: ‘Well, that was too emotional. That was too powerful. Human connection is powerful, and trying to convey that to somebody that's never known another person, this person on the earth, to convey their lifetime of 37 years down to a two-hour sentencing event is hard to do, and I think that victims and victims' families should be afforded every opportunity.”

After sentencing, Horcasitas appealed. He argued that the AI Pelkey video was inadmissible because it carried “undue emotional weight” and that the “lifelike AI recreation of the victim conveyed an authority and authenticity” had a “psychological impact” on the judge, according to court documents reviewed by 404 Media.

The appellate court agreed and cited State v. Rose, a 2007 murder case where a man was sentenced to death for the murder of a police officer. During the victim impact portion of the sentencing in that case, the judge saw photos of the police officer’s children at his graveside. The court said those photos almost crossed the line into prejudicing the judge.

“The AI video crossed that line. Unlike the photographs in Rose, which captured a particularly poignant moment for the young surviving victims, the AI video here [...] does not reflect actual events,” court documents said.

“It clearly impacted the sentencing judge, who said he ‘loved the video’ and felt it ‘was genuine,’ pointing to the AI victim’s ‘obvious forgiveness’ of Horcacistas,” the court documents said. “On this record, the judge’s consideration of the AI video so prejudiced Horcasitas as to render the sentencing procedure fundamentally unfair.”

Wales and the rest of Pelkey’s family have spent the last five years in and out of various court rooms related to his death. If the current ruling holds, then she'll travel to Arizona from New York and give the same statement she did the first time through her brother’s AI-generated mouth, minus the AI-generated video. The same judge who originally said “I loved that video” will do the sentencing.

“Likely, the same people will go back down and make their speeches, and I will be making my victims' impact statement that I wrote for myself the first time around again, and I will be delivering Chris's AI script sentiment again,” she said. “If I need to stand there and read it myself, which would be legally lawful, I am prepared to do that. Chris's sentiment does not change. The delivery method will.”

Wales said she wrote the words that came out of the AI version of her brother, they weren’t AI-generated. She also noted that only the judge, her family, and the Horcacistas family were the only people who saw it during the trial. “This was not offered as evidence. Juries never saw this,” she said. “This was only created after a verdict was solidified, a guilty verdict.”

She also noted that the AI video was only one of a larger piece of testimony given that day. “I think that [the judge] is unfairly represented with a soundbite,” she said. According to Wales, the judge spoke for around half an hour and only mentioned the AI video once. Wales herself uploaded the soundbite from the judge saying he loved the AI-generated impact statement to YouTube, where it went viral.

But she also said she understood that AI is a new technology and when she played the AI-generated video of her brother that she was doing something no one else had done yet. She compared it to the way courts thought of photography in the late 19th century.

“It took about 15 years [...] and about five landmark cases in the United States that went all the way up to the Supreme Court before photography was an accepted standard to be used in the courtroom for evidence, identification, and testimony, et cetera,” she said. “I believe that's what we're seeing now with AI. It is a brand new medium.”

Wales said she understood she was setting a precedent, for good and for bad, and that she was OK with that. “There is always that first case, and so that mantle weighs on me that I need to be careful with how I defend this and how I explain the impetus, the goals, the motivations, and the veracity of what was created, because there are victims that depend on freedom of speech for the future, and I do believe that victims and their families should have every opportunity available to them to make their their points,” she said.

There’s no firm date for the new sentencing. “We do respect the court's opinion, and if we need to operate in those guardrails, I am prepared to read the same script that the AI version of Chris read the first time around,” she said. “His sentiment has not changed. Our opinion of what we believed he would think about this whole thing has not changed. The words I penned as Chris's imagined opinion still have not changed and will not change.”

Former Obama official will review Cornell’s handling of sexual misconduct complaints

School trustees appoint Sally Yates to review policies as university grapples with fallout from alleged frat gang rape

A former high-ranking Department of Justice official will look at how Cornell handles sexual misconduct complaints, university trustees announced on Tuesday as they tried to address an outpouring of anger over allegations of a 2024 gang rape at a fraternity house.

Sally Yates, who was a deputy attorney general in the Obama administration, will spearhead the review, the trustees said. The assessment is to include how the Ivy League university investigates reports of sexual assault and sexual harassment, how the disciplinary process works, the adequacy of campus police responses, and more.

Nobel prize in physics 2026: high energy cosmic neutrinos

Second up for the 2026 Nobel Prizes was the award for physics. And this year it went to just one scientist, Francis Halzen. The Belgian physicist won the prize based on his work on the IceCube detector that observes ghostly particles called neutrinos. Science editor Ian Sample tells host Madeleine Finlay how Halzen came up with the brilliant idea to use sensors buried in the ice to detect these extraterrestrial particles.

Senior academics set out key questions Cambridge must answer over Jason Arday’s death

Letter from more than 40 signatories says university has backed away from promised thorough review of events before death

Senior Cambridge academics have criticised the university’s plans to investigate Prof Jason Arday’s death as inadequate, and said those responsible for “serious failures of leadership” should face consequences.

In a letter to Chris Smith, Cambridge’s chancellor, the academics said “it is not yet clear” how the proposed review will answer difficult questions about the university’s involvement in the events leading up to Arday’s death, including its handling of the criticism Arday suffered after his appointment as professor of sociology of education in 2023.

The Guardian view on the French school protests: the political class needs to heed the voice of students | Editorial

A generation facing unprecedented challenges deserves better than an underfunded education system

One of the most famous slogans in France’s May 1968 student protests declared “L’imagination au pouvoir” (Power to the imagination). In a postwar context of steady growth, the ’68ers dreamed of shaping an egalitarian society, freed from the social constraints of their parents’ generation. Nearly five decades on, in a very different economic climate, the goal for most of the tens of thousands of pupils disrupting schools across the country is more modest. As one placard on display had it: “I’d like to be worrying about my maths exam, not my future”.

A huge turnout of hundreds of thousands of protesters on Tuesday – a number that included many parents and teachers – confirmed the depth of resentment at years of budget cuts leading to crumbling school buildings, overcrowded classes and chronic staff shortages. Other complaints point to a lack of resources to deal with the now frequent heatwaves that make classrooms intolerable in May and June, and the unfairness of an opaque, algorithmically driven selection process for universities.

Explain it to me like I'm 80

Mom: What's with these AIs escaping and hacking people? That sounds scary.
Me: You park your car at the top of a hill. You leave a note on the dashboard that says "please be good" and then you pull the parking brake. The car careens down the hill, smashes everything up, and you put out a press release saying "My car ignored my instructions! It hallucinated! It went rogue!" Your insurance company not only believes you, but invests a hundred million dollars in your company.
Mom: Jesus Fucking Christ

Researchers Are Tracking a Chinese AI 'Agent Fleet'

Independent researchers say they've identified a large "fleet" of AI agents apparently running on Tencent infrastructure and making parallel queries against Alibaba's Amap mapping service. TechCrunch reports: Researchers, however, resisted the term "swarm," noting that there seems to be little coordination between their different queries. "'Agent fleet,' not 'swarm:'" one researcher wrote in the preliminary report, "many parallel agents on the same kind of task, with no sign of communication between them." The agents were discovered by monitoring traffic to the domain-scanning service urlquery, a technique that previously revealed long-running activity by OpenAI agents. AI agents often use urlquery to load websites that they cannot access directly, leaving a record of their activities that can be valuable to researchers.

In this case, the record showed queries to Alibaba's Amap service, seeking directions to different entrances of various public places, including a park, a zoo, and a hospital. The research is ongoing and so few details are available, but the behavior shows how persistent AI agent activity has become on the internet. In the wake of the Hugging Face incident, many researchers are actively monitoring for rogue agent activity on the internet. Much of that activity has been easy to find because agents tend to use the same techniques and make little effort to conceal themselves.

Taking A Stand: Cornell University Has Officially Paused Its Rape & Assault Undergraduate Major Program

In light of their failure to appropriately respond to the severity of a 2024 sexual assault case, Cornell University has finally taken action and officially paused its Rape and Assault undergraduate major program.

It’s about time!

Though the Rape and Assault undergraduate program has been a historic part of Cornell’s 161-year tenure, this pause will allow administrators to examine whether or not the program, which includes courses such as Introduction to Molesting and Roofies 301, played a significant role in the 2024 gang rape of a student. Students who have already declared their major in the department will be able to complete their bachelor degrees, but new students will not be permitted to enroll in the major at this time.

Said the University in a statement, “It has come to our attention that undergraduate students in our Rape and Assault program may have used what they learned to commit rape and/or assault. This was never our intent, as seminars like ‘How Much K Is Needed To Make Sure She Forgets Everything?’ and visiting professorships by Harvey Weinstein and Bill Cosby, were only ever meant to provide students with a well-rounded education. As we assess the situation, prospective Rape and Assault majors should consult with their advisors regarding Cornell’s other exciting academic offerings, such as Hotel Management and Beekeeping.”

For some this might be considered too little too late, but props to Cornell University for trying to make things right.

Zin in vapen nu.
