Overheidsregulering heeft een duidelijk doel: markten eerlijker maken en consumenten beschermen. Maar in de praktijk leidt strakke regulering soms tot onbedoelde neveneffecten. Wanneer prijzen kunstmatig worden vastgesteld, producten aan strenge beperkingen worden onderworpen of vergunningseisen de markt verkleinen, gaan consumenten op zoek naar wat elders beschikbaar is. Dat patroon herhaalt zich in opmerkelijk veel verschillende sectoren.

De sectoren hieronder illustreren hoe regulering, hoe goed bedoeld ook, consumentengedrag kan sturen in een richting die beleidsmakers niet altijd voor ogen hadden. Van energie tot online dienstverlening: het mechanisme is telkens vergelijkbaar.

1. Energie: hoge tarieven ondanks markttoezichtDe Nederlandse energiemarkt staat onder intensief toezicht van de Autoriteit Consument en Markt (ACM). Toch ervaren veel consumenten de tarieven als hoog en ondoorzichtig. De warmtemarkt is daar een sprekend voorbeeld van: eind 2024 waren er ruim 700.000 huishoudens direct of indirect aangesloten op warmtenetten, een markt die fundamenteel verschilt van elektriciteit of gas omdat afnemers vrijwel geen overstapmogelijkheden hebben.

Dat gebrek aan keuzevrijheid is precies waarom regulering in deze sector zo gevoelig ligt. Consumenten die wél de mogelijkheid hebben, zoals huiseigenaren met ruimte voor zonne-energie of alternatieve verwarmingssystemen, kiezen steeds vaker voor een oplossing buiten het gereguleerde net. Volgens de ACM-rendementsmonitor 2024 was het sectorbrede gewogen gemiddelde rendement van warmteleveranciers in 2024 zelfs licht negatief, op -0,3 procent, een historisch dieptepunt.

1. Online gokken: strenge licenties veranderen consumentengedragSinds de inwerkingtreding van de Wet Kansspelen op Afstand opereert de Nederlandse online gokindustrie binnen een streng vergunningstelsel. De Kansspelautoriteit (Ksa) stelt hoge eisen aan aanbieders, wat de markt weliswaar veiliger maakt, maar ook kleiner. Aanbieders die niet aan alle vereisten voldoen, vallen buiten het vergunde aanbod.

Voor sommige consumenten betekent dit dat zij hun blik verruimen naar internationale aanbieders. Wie een buitenlands alternatief voor Nederlandse casino's onderzoekt, doet dat vaak niet alleen vanwege de beschikbaarheid van platforms, maar ook vanwege verschillen in spelaanbod, betaalmethoden, bonusstructuren en accountfunctionaliteiten. Veel internationaal gelicentieerde aanbieders bedienen meerdere markten tegelijk, waardoor zij een breder productaanbod kunnen ontwikkelen dan operators die zich uitsluitend op één nationale markt richten.

Dat heeft effect op het aanbod dat consumenten binnen Nederland kunnen bereiken. Volgens Law en More worden de vergunningstelsels in 2025 verder aangescherpt, wat de drempel voor nieuwe toetreders verhoogt. Een smaller vergund aanbod kan ertoe leiden dat spelers alternatieven buiten de Nederlandse markt verkennen, een dynamiek die ook in andere zwaar gereguleerde sectoren herkenbaar is.

1. Telecom: bundelrestricties leiden tot buitenlandse providersIn de telecomsector hebben Europese regels de markt op veel punten opengebroken, maar nationale aanbieders opereren nog altijd binnen een complex kader van verplichtingen en tariefregels. Consumenten die flexibele of goedkopere oplossingen zoeken, stuiten daardoor steeds vaker op de grenzen van wat het nationale aanbod biedt.

Digitale alternatieven, zoals buitenlandse simkaartproviders, eSIM-aanbieders of internationale data-abonnementen, winnen aan populariteit, met name onder frequent reizigers en digitaal vaardige gebruikers.

De regulering beoogde eerlijkheid, maar creëerde tegelijk een prikkel om buiten de traditionele structuren te zoeken. Dat illustreert hoe strak toezicht de markt in onverwachte richtingen kan duwen.

1. Financiële diensten: regulering drijft naar buitenlandse fintechsDe financiële sector kent misschien wel de zwaarste reguleringsdruk van alle sectoren. Vergunningseisen, compliance-verplichtingen en strikte adviesnormen zorgen ervoor dat traditionele aanbieders traag en duur opereren.

Consumenten die sneller of goedkoper geholpen willen worden, stappen over naar buitenlandse neobanken en fintechs die buiten de Nederlandse regelgeving vallen of onder een lichtere Europese vergunning opereren.

Platformen als Revolut, Wise en Bunq trokken in korte tijd miljoenen Europese gebruikers aan, ook uit Nederland. Veel van deze gebruikers kozen niet bewust voor een buitenlandse aanbieder, ze kozen voor gemak en prijs.

Dat de aanbieder toevallig elders is gevestigd, is een bijproduct van de reguleringskloof. De ACM Staat van de Markt 2026 benadrukt dat toezichthouders deze verschuiving naar buitenlandse digitale diensten actief in de gaten houden.

Wat regulering werkelijk bereikt bij consumenten

Regulering is onmisbaar voor eerlijke en veilige markten. Maar de vijf sectoren hierboven laten zien dat de effecten niet altijd verlopen zoals beoogd. Wanneer toezicht leidt tot hogere kosten, minder keuze of een ondoorzichtig aanbod, zoeken consumenten alternatieven, soms buiten de nationale grenzen, soms buiten het officiële kader.

De uitdaging voor beleidsmakers is niet om minder te reguleren, maar om slimmer te reguleren. Regelgeving die keuzevrijheid respecteert en transparantie bevordert, houdt consumenten binnen het beschermde systeem. Regelgeving die dat niet doet, duwt hen er juist uit. Dat is een les die in vrijwel elke gereguleerde markt opnieuw geleerd wordt.

High unemployment and a lack of support mean life can be tough in Grimsby, but 19-year-old Cohen is determined to make the best of life in this coastal town

It’s mid-afternoon in the Lincolnshire seaside town of Cleethorpes and Cohen is sitting in the back seat of a car putting on an Easter bunny outfit. A group of teenagers nearby stare in amusement. Cohen isn’t fazed. He is hoping we can take some new photographs that he can use to advertise his mascot business for the upcoming holidays.

Cohen, 19, lives with his parents a couple of miles down the road in neighbouring Grimsby and set up Co Co Mascots last year as one of his many attempts to find work. People can hire him in one of the outfits for birthday parties, events and doorstep surprises for children. He’s done a few paid gigs so far, which has been a boost for his confidence, he says, but what he really wants is a permanent job.

Biebrza marshes, Poland: It’s not just the abundance of elks, orchids and eagles that sets the mind racing, it’s the wild interactions between the ‘exotic’ and the familiar

Have I made a mistake in visiting Biebrza national park? Not that I mind encountering more bird species in a day than I do in a year at home. Nor do I regret meeting a young elk, all gangle and improbable proportions; or kneeling before a clump of lady’s slipper orchid in jaw-droppingly ostentatious bloom among Solomon’s seal and a carpet of lily of the valley. I definitely appreciate the homely clatter of the neighbourhood white storks, and the constant soundtrack of cuckoos and golden orioles. I certainly have no objection to watching the sunset from a wood-fired hot tub, listening to corncrakes as bats emerge and a beaver cruises past.

But something shifts in me when, in the space of a few minutes in an observation tower, we watch three species of marsh tern hanging like precision-engineered angels to tweezer insects from the water’s surface, and a white-tailed eagle hunting greylag geese then settling with its mate in a dead tree to watch a train of common cranes in the field below meeting a lone fox, all leaping as if in mock surprise, before going unconcernedly on their way.

Vandaag beleven we de warmste dag van het jaar tot nu toe, met ronduit tropische temperaturen in het Rijnmondgebied. De zon schijnt volop en vanmiddag loopt de temperatuur op naar 30 of 31 graden. In de grote steden kan het zelfs 32 graden worden. Verder is het rustig zomerweer met weinig wind.
